Do roots grow under neighbor's land? This is legally grey. Roots merely seeking nutrition: usually okay. Roots damaging paving: possibly damages claim.

Solution: Root barrier or move hedge.

Belgium: Hedge on boundary (slightly different)

Belgian law (especially Flemish rules) is similar but more specific:

Hedge must be 3 meters from boundary

Important: In many municipalities, hedge must be at least 3 meters from neighbor boundary. Check your local rules.

Rule: Planted hedge too close to boundary? Neighbor can force you to remove it or cut it back.

This applies especially to hedge over 2 meters tall. Small hedge (under 1.5 meters) sometimes less strict.

Pruning right on overhang

Belgium uses same rule: neighbor may cut overhang themselves to boundary line. Difference with Netherlands: you must warn neighbor in writing (some regions):

  • Send neighbor letter that hedge overhangs
  • Give him chance to cut himself (usually 1 month)
  • Only then cut yourself (if he doesn't)

Dispute? Municipality involved

Bad relations with neighbor over hedge? Municipality can mediate. Report to building or green oversight.

In serious cases (hedge damages property): civil case in court.
